Changing Employer

Hi,

My scenario is, > 180 days past I-485, I-140 & EAD approved and want to
change employer. I am currently employed with company A, in the chain are
company B & Company C then the client, company C is authorized vendor
to the client. In this situation, can I join directly join Company C using EAD?
what are the implications? can my current employer withdraw my underlying
I-140 petition?

Secondly, after I join company C, can company A technically sue me if
Company B fails to pay billing dues owing to me leaving company A suddenly?

Please shed light on the issue above.

Thanks,

Rosaly

rosaly,

you can use ac21 and move to company c with your ead. since you are past 180 days, i-140 revokation should not have any effect on your pending aos application. however there have been cases where an i140 revoked after 180 days had a negative effect on the pending aos application.

for the second question, i am not sure what your employment agreement is...this is a matter for legal experts.

Generally non-solicitation agreement is signed between companies and consultants. Its upto company to sue u or not.
They can ,if they want ,if there is some NSA agreement (99.9% it is).
So problem may be NSA not INS.

IT will depend upon which state you live in. Every state has its own laws regrading this. Like California they ca't sue you so check you state laws.

Krishnakt, wanna_gc, ghost-rider ..

Thanks for all your inputs!

Yes ghost-rider, I work in Calif but consulting company is based in Delaware,
so if I have to be safe, should the company be based in Calif / Employee working in CA is also ok? thanks again!
