I am currently working on H1B and work for a Fortune-50 client as sub-contractor. I am planning to change my employer for green card purposes as my current employer is not in a position to do the same.
What should I look for in a new employer?
Following are some of the points that I know I should ask.
1. What is the size of the company, that is the number of employees.
2. How old the company is?
3. What is the annual revenue?
4. Any H1B or labor rejections?
5. If working on percentage basis-hourly, what would be the percentage shared by employee and employer?
6. Who pays the employer's share of tax?
7. Is medical insurance offered by the employer, if yes does he pay fully, or the employee shares part of the payment, or if employee pays fully?
8. Is employer willing to file green card? If yes how soon? Does the employer have option of filing in fast track states like Iowa, South Dakota, Maine, Delaware etc.?
9. Who will bear the expenses for filing green card, which includes, Attorney fees and INS-DOL fees?
10. Does the employee, have the option of choosing his own Attorney for filing green card? If not, why not?
11. If employer has agreed to file for green card, filing with RIR or non-RIR?
12. If RIR, when was the advertisement done, is it done in the last 6 months, can proof be provided by the employer?
13. Who will bear the H1B(if being filed) and or premium processing expenses?
14. If the client, where the employee works, makes the payments to the employer delayed by say 2 months, then will the employer make timely payments to the employee, or will the employer be also delaying the payments to the employee?
15. Is there any bench pay? I doubt this anyway.
16. If the current term with the client ends, and the employer finds the next job, what will be the salary that the employer offers?
Already its a big list, but I think there can be some more points that can be added to the above list.
Any additions by the gurus here would be greatly appreciated.
