Changing Attorney for AC21

Hi ,
I have some questions. guru's please respond..


What steps should we take to change Attorney for filing AC21?

Is sending G-28 is enough? how does this work? and who should send this?

Will the previous attorney( controlled by previous sponsoring employer) sends the complete file to new attorney including Labor details?

Can we call USCIS to find out which Attorney is representing us?

----- hire new Attorney , sign the form G28 and let him update the USCIS and send AC21 papers with your reciept of I-485 copy and new job offer letter

------- your lawyer can ask for it but the past company lawyer may not give you LC or I-140 papers as they belong to Employer not to you. lawyer should give you copy of I-485 forms EAD AP forma copy as they belong to you
Can we call USCIS to find out which Attorney is representing us?
------- the latest G28 filed by your lawyer is represensing you. you know who sent latest G28 that YOU signed

Why do you need attorney, just to file AC21? You can yourself do it. It is a simple process. If you have a copy of offer of new employment (which states the the job is similar to previus one), that it self sufficient to file a AC21 along with your cover letter.

I do have one more question. I only know the job title mentioned in Labor. I dont have job duties. My title is Programmer/Analyst. I applied for FOIA but its taking very long to get my labor details.

What should I do in this case? what kind of job duties should I use? my new employer is ok with anything.

please help :(
 
It is not necessary to know or match the exact duties in the LC. The important thing is job classification should be same. Do not waste time in FIOA. Get help from Onet and get a letter from current employer to have the job duties listed briefly, to have the actual job functions and it should be in line with Programmer/Analyst as per O.net.

My lawyer avoided giving exact job desc in AC21 letter. (I had a copy of labor). It mentions the title and says that the duties are same.

Agree with Greencardvirus.

My view is NOT to send the AC21 letter pro-actively. It will not help your greencard in any manner. When and if you recieve RFE, then update USCIS.

Since you will be hiring a new attorney, get his advice when filling G28.

If your new Lawyer ask for $$$ to send AC21 letter. Do it yourself. Its merely informing USCIS that you know what AC21 is and its applicable in your case so that some dumbass officer does not "temporarily jeopardise" your case.
