hi
icame to us on H4 visa. after that i changed h4 to H1 visa, but i didn\'t work.i didn\'t get a H1 visa stamp on passport. i have a valid H4 visa until 2003.my question is now which is my visa status? can i use H4 ?

You are on H1 status now

Irrespective you got stamped or not you are on H1 status now. The moment your H1 application approved you status changed to H1 from H4.
If you are not working I mean if you are not on company payroll , then it is highly highly recommended to change back to H4, so that you will not have problem of \'OUT of Status\'

You may apply again for change of status to H4 or the quick way would be go out of country and enter with old H4.

By the way when did you get your H1.

Please confirm with your lawyer.
 
same situation

can we come back on the old H4 even though spouse is on diff H1 (changed to differnet company).can we travel to india(me and my spouse ) and come back using the same old H4 and H1(we will take new H1 with us).
Is it advisable to come back with old H4 stamp or get a new H4 stamp based on my husband new H1 in India.

I am in the same boat and want to change to H4 from H1. Please let me know the process involved in it.
 
The quickest way to change from H-1 to H-4

Leave the US and either enter on an existing H-4 visa that is still valid or go to a consulate and get a new H-4 visa stamp. Reenter the US on the H-4 visa stamp. If you don\'t want to leave the US, file an I-539 to changs status to H-4.
