change status... from a B VISA

My husband is actually on the I485 waiting for his EAD... I came to the States on a B2 tourist VISA. My husband is on the bench and his H1 ended on Aug,31. When I came in I decided to come on my B VISA (was already issued) because my husband's lawyer said his company could not give me a letter saying my husband was working for them since he was on the bench.

How can I change my status and ask for an EAD for myself? I have heard I cannot change satus (adjustment of status) since I came in as a visitor. Is this correct?

Willl this be a problem or delay my husband's process?

No

You can file adjustment of status, (I485), EAD (I765) , AP (I131) using your spouse's I485 receipt copy and you will be in legal status from your 485 receipt date.

Are you sure I can file those being on a B status? My husband's lawyer said he could only apply for me after I get an H4 status...
