Change statues FROM F1 to H1B

My H1B get approved on October 29 2007. My lawyer filed an amendment for changing my status from F1 to H1B in the U.S.A. Vermont immigration received my petition on Jun 25. I checked the processing date they still working on petition who filed on April 2 . How long do you think will take my process? My F1 will expire on October 14. Can I remain legal in the U.S.A until I get respond about my case from immigration?
