change of status w/avail visa number

Hello all,

First, I must say that I am rather ignorant of immigration matters, so if I am misusing any terminology here I would truly appreciate any pointers. Also, I am trying to provide as much relevant information as possible but if I have left anything out I would also appreciate any guidance.

My wife came to the US legally from Mexico with her family in the mid-80's (at about 9 years old). Her visa expired, but a lawyer hired by her mother filed the necessary paperwork and she now has an immigrant visa number available to her. Unfortunately, her status under this visa is listed as single and living in Mexico. She is currently married and living in the US. We have a three-year-old daughter who was born in the US and her mother has since become a US citizen.

We recently received a notice that unless my wife takes action by June, her visa will no longer be available. From the many INS hotlines we have called, most of the operators have told my wife that she cannot receive her visa until she updates her status with them. However, none of these helpful folks have been able to give us even remotely similar instructions on how to do this.

Please let me know if you know of anything at all that could be useful to me. Even if you do not have an answer for me, I would love to at least feel comfortable that I am correctly asking my question.

Finally, we have spent a small fortune on lawyers and most of them have simply taken our money and provided little help. I don't know if I could possibly afford any more professional advice, but if that is the only way to proceed I suppose we'll have to do what we can.

Please let me know what you think, and my most sincere thanks for any help you are able to provide.

Lots of complications? Arrgh. I was hoping it would be a simple matter but I guess it never is with immigration, particularly since 9-11.

Thank you for the correction on the "change of status" terminology. One less silly mistake to make!

Something I should have asked in the first place...

Our luck so far with lawyers has not been so good. Any advice on choosing a good lawyer in my area (north-central Florida)?
