I am on F1 student visa and my wife came to the US on a F2 dependent visa. She got her H1 visa through a consulting company in December 2006, but she hasnt started working yet. The company couldnt find a job for her till this time and now we dont want to keep the H1 as it may cause some issues later. When I started looking to transfer her H1 to F2, there is a question in the form asking whether she has got any employment history during the past years. I taked with the consulting company and what they are saying is, since she hasnt used her H1, she doesnt have to put her current status as H1. My queries are
1. Since she has got her SSN and also did the change of status, is it true that her status could be kept as F2 with an H1 approval.
2. Is her F2 visa still valid? Will she end up in some problems later when we file for green card if we doesnt disclose the information that she owned the H1 during a short period of time.
Please give me a reply as we dont want to get into trouble later.
