Change of Status from F1 to H1

I am a student currently pursuing my PhD and came to the US a year ago. I did an internship in a company here and they want me to join them as a full time and are willing to sponsor my H1. Would there be any legal issues or any problems in me getting a H1 as I would have to change my status from F1 to H1 without completing my studies.

I am sure that it is fine if I can graduate but I am not going to graduate as I will be discontinuing my course. Is this a problem in anyway. I will be no where near graduation.

Do I have to go back to India to get a VISA
 
No you may not necesarily complete you PHD if your H1 is sponsored based on your Bachelors or Masters degree. The min requirement for H1-B is a Bachelors.

So you apply H1-B based on that. At the time of application double check with your attorney also.

On a side note - Completing your PHD may help you in Green Card though. After having PHD you are eligilbe to fall in a special category and if you do then you can get your GC very fast.

Out of 3 stages of GC, I am sure 1st stage will be waived and may be 2nd (not sure about the 2nd though)
 
Would me getting a H1 now later cause any problems when I apply for my GC. I mean it shouldnt be a problem isnt it that I didnt complete my graduation.
The other question is that is it a must that I must go back to India to get my Visa stamped on my H1 or can I transfer my status here in the US without going to India once I get my H1.
