Change of status approved without the J-1 waiver

I need your legal advice!
I have the H1 petotion approved and also the change of status was approved as well.
What I don't have is the proof of J1 waiver.
Can I apply for the new visa stamp without having the proof of waiver, but having the change of status and the new I-94 valid until 2007?
IT"S URGENT!!! Please advise.
I've been to the Consulate for the visa stamp and they ask me for the waiver. Is the approved change of staus enough or I still need the waiver?

they will still ask for the waiver. You can't even change your status without it (unless you are changing from F1), so it's an oversight on somebody's part.
 
I have the change of status approved, but the USCIS didn't send me the final response on the waiver case.
Having the change of status approved means that the waiver was approved as well.
I said that to the Embassy but they are still asking for the waiver. I don't understand why, having the change of status is more powerful then the waiver.
How can I present the facts to convince the US Consulate do not ask for the waiver?
