Anyone who can help...My H1B and my wife's H-4 application is pending with the VSC (I will pursue J1 waiver job on H1B). My wife is finishing 2nd year medicine on J-2 EAD. Begining July 1, 2006 she doesnt have EAD. She is being put into administrative elective for beginning of PGY-3. But to continue working in the program she need her own H1B.

Q1. Do we have to wait for my H1b and her H-4 (COS from J1 and J2) to be approved before we apply for her own H4->H1b to finish PGY-3?

Q2. Employment date on my H1B (07/01/06 to 06/30/09) with filing date of June 8, 2006 at the VSC (regular processing). Therefore it is nowhere close to approval at the moment, unless we upgrade to premium. Question is, can the employer amend the starting and end date on the H1B when upgrading to premiuim ? (as july 1, 2006 will be gone-by before the case is approved or upgraded to premium) Idea her is to obtain an H1B for full 3 years instead of 2 yearr and say..10 months!
 
why dont you dont you apply for NIW straight away,so your wife can get an EAD to cpmpleter her residency

These are the few Qs I have.
1.) Can one sign for a child (less than a year) who cannot read or write in filling the form D230 for other family members? Can the child be made to thumb print in place of signature while the form is filled for the child?

2.) Is the the winner that has to fill and sign for all his/her family members included in the entry?

Pls let any son of man around the world who has passed through this road or has the experience help out in this regards.

I can not since I am from the retrogressed country (India). All I will be able to get is I-140. You remember we talked about the sample letters from...fax etc?
