Change of employer

My AOS is pending for over 20 months. My employer is asshole and doesn't pay me in time . I tolerated so far thinking that GC would be approved soon. Looking at the current trend I think it is going to take a long time.


Now I want to switch employer using EAD. If do so as per AC21, does it result in " my not intent to work for the sponsor". In other words to use AC21 to switch employer does employee has to be laid off. Or can a employee switch after 180 days of AOS pending with approved i-140.

Gurus please help me on this .
 
Employee can change after 180 days without being laid off. Ur intent to work forever for the sponsoring employer needs to be till ur 140 is approved and 180 days have passed since filing 485. So, the forever intent is not required forever (no pun intended, whatever...)

bottomline - u can change without any risk. Make sure u have copies of ETA 750 A/B and 140 approvals before u leave.

your case seems to be good for AC21 - so I guess there is no reason why you shouldnt switch jobs if you are not getting paid.
