Change of Employer

My AOS is pending for over 20 months. My employer is asshole and doesn't pay me in time . I tolerated so far thinking that GC would be approved soon. Looking at the current trend I think it is going to take a long time.


Now I want to switch employer using EAD. If do so as per AC21, does it result in " my not intent to work for the sponsor". In other words to use AC21 to switch employer does employee has to be laid off. Or can a employee switch after 180 days of AOS pending with approved i-140.

Silly Man, other gurus please help me on this.
 
AC21

AC21 doesn't mandate employee that he/she should be laid off to switch employers. If your GC is pending more that 180 days and i140 is approved, you can switch jobs.

You may want to make sure that you get all plausible docs [pay stubs, Employment letter.., etc] from the current employer...just to be on safe side!

From what I have understood, it is easier to change jobs before getting GC , than after getting GC. Experts advise that you should stay with the current employer for at least 6 months before changing jobs after getting GC.

As all experts advise on this forum and elsewhere, try o look for same title, same job description & >= LC salary.
