Change of Employer ISSUES - 140 approved, 485 pending for more than 180 days....

Hi,

My 140 has been approved and 485 has been pending for more than 180 days. I have questions regd. changing of employer -

1 - When we say 180 days, is it business days Or total no. of days?

2 - My lawyer hasn't signed any contract with the employer and has just got the representation form. He says he can't help me in AC21 at all as its 'CONFLICT OF INTEREST'. Not sure what this means ?

Has anyone here changed his or her employer? Is there a way out without changing your lawyer?

Gurus, pls. help!
 
It is always total number of days.
They count 180 days from ND. USCIS officers call Notice Date as receipt date.

Totall days from the 485 Notice date.

If you are continuing with the same attorney as that of your employer, he might not help you in furthering the case. Contract a different attorney and they would help you. But since your 140 is approved you might not need a attorney unless a dire situation arises.

Do I need to go through a Lawyer for AC21 or can I apply on my own?

Within how many days of change of employer do I need to file AC21 ?

If I change my attorney, what all receipts etc. shall I take from him - so that I am prepared for the future lawyer and 485 RFE etc.
Any inputs, cautionary measures etc. would be great help to me - as I am novice in this area. Thanx!

A lawyer is not required. But if you feel that your application is not clean an attorneys help might be required. By clean I mean that you were in status during the whole GC process, you have all applications in original and you have all W2 forms etc.

It is not mandatory to file AC21. You may inform at your leisure.

Your new attorney should know this. He needs to file form G-28. Talk to your attorney.

At this moment just ensure that the new job is similar to the one specified in the LC.
