Hi,
My I 485 is pending more than 1yr with i 140 approved.
I changed my job from original GC employer to new Employer.
Have good contact with original GC sponsering Employer.

But attorney who filed GC is from Original GC sponsering company. Today i spoke with my company regarding RFE that INS usually Sends out. I did not get any rfe. but i spoke with them in advance about .

W2, Employer tax return, salary( i had low earning 15k in 2003).

They said they can give Enough reason for low earning in 2003 if there is any RFE.
They said they will send EVL letter from their side, Even though I work with other Employer. I don;t know How they will provide Pay stub copies( Seems to be complicated, they will mess GC )
I am afraid of my original company since it is small , business is not good.

Right now i am working with new employer. Company strength is 30 to 35 employee.

Hence I have decided to have another own attorney from my side
without going thrugh any Employer's Attorney so that if i get RFE , it will be sent to my new attorney.

If i file G28, Will INS inform abt the change of attorney to my original Company's Attorney. I don't want INS informing that to original attorney. I don;t want loose communication with my old employer too. At the same I want to have rfe under my new attorney control. My new Employer will help me in providing all docs for RFE.

WILL INS PROMPTLY SEND RFE TO NEW ATTORNEY , WILL INS MESS IT BY SENDING TO OLD ATTORNEY ???????

Thx

--------- your I-140 is approved and no RFE will be sent for I-140, I-485, EAD AP belong to YOU and if any RFE for I-485 it will go to the lawyer who filed I-485, better hire your lawyer file new G28 and provide copy of your I-485 filing reciept to him so that if any RFE it comes to YOUR lawyer
W2, Employer tax return, salary( i had low earning 15k in 2003).

------ that is not problem GC is for future job
They said they can give Enough reason for low earning in 2003 if there is any RFE.
---- I dont think you will get RFE for I-485 and ask about your past wages on H1 status
They said they will send EVL letter from their side, Even though I work with other Employer.
----- Now you dont need EVL from past employer if you have used AC21 or joined new employer, you will need Future permenent job offer letter from new employer and will mail it to USCIS
I don;t know How they will provide Pay stub copies( Seems to be complicated, they will mess GC )

------ pay stubs that you will need now will be from your new employer if RFE they will just ask for 3-4 recent pay stubs from present comany to make sure that company is paying and can pay after the GC approval
I am afraid of my original company since it is small , business is not good.
------ inform them you dont need any letter, pay stubs from them at this time . they have nothing to do with your I-485 now if you joined new employer

Right now i am working with new employer. Company strength is 30 to 35 employee.

----- Good
If i file G28, Will INS inform abt the change of attorney to my original Company's Attorney.
--- No they will not inform past lawyer your new G28 will be at top in your pending file and they will send RFe if any to new lawyer

------ why do you expect RFE??????, they may not send RFE if you or your new lawyer inform USCIS about your intent change and send the AC21 letter from new employer for future permanent job offer letter
Thx

Hi Ginnu

Thanks for your reply.

I have got few clarification.

>>They said they can give Enough reason for low earning in 2003 >>if there is any RFE.
---- I dont think you will get RFE for I-485 and ask about your past wages on H1 status

In 2003, My total earning was 15K & I filed my i 485 in Oct 2002. I had h1b as backup along with EAD & AP. My company used my h1B.

By chance if i get rfe ( I did not inform INS abt change of Job), that time i can reply with AC21 letter. Is it so????.

Thanks
sank
