Change J1 waiver job.

I am a J1 doing my 1st year of waiver. My employer is making me work at another office that is in a different county. It is not in my contract to work there.
Also I have been asked to become a medical director of a nursing home that is not in my contract. I also have to go to other nursing homes.
Does all this qualify as "extenuating cicumstances" and can I change my job based on this.

What papers would I need to support my case.

Please advice.
 
Sure u can

By doing so your employer is forcing you not to comply with your LCA and breaching the waiver obligations which are clearly site specific.Get a support letter from health department ( not necessary but recommended) and file H transfer to another HPSA for the remaining period.

What papers would I need to support my case - that I am working at a different facility then one in my contract.
And what papers would I need to prove that I have been going to Nursing homes.
 
draft a personal letter detailing all the abuse ,breach of contact,forcing you to work outside your H1 provision etc.

get a letter from the nursing home manager that you see patients there on behalf of you employer.Invent a reason!

if health dept is friendly notify them of your situation and express your desire to transfer to another HPSA where you are not forced to illigal employment activity etc.Be innovative.Good luck!

I will suggest to make a log book.Enter the time when you reached a nursing home which is not part of your contract,patient's name ( on which you write note),time you leave etc.Technically you can not make copies of medical records but if Labor dept investigates then they will be able to substantiate your claim.Nothing beats specific data rather than loose allegation.
