I saw a change in my I-140 LUD after 2 and a half months of approval and there was no change in LUD for my I-485 or I-765. What does that mean? Any comments would be appreciated. Thanks.

I saw a LUD in my I 140 after 6 months of approval. message was your approval information is transmitted to the consulate, port of entry etc.
No LUD with 485. so this may be a routine message.

I-485 filing for pending I-140 (EB1-EA) applicant

Hello Jiffy30/eb1doc or other experts,
PD for EB1 is current, Does that mean someone from India now can file petitions for both I-140 and I-485 concurrently for EB1A category? or do they have to wait for I-140 approval.
My I-140 EB1-EA is pending at NSC, do you think I can file I-485 now?
Thanks,
vr

You don't have to wait for I-140 approval. Go ahead and file for I-485 (and also EAD and AP, if you want) on or after Sept. 1, 2006 and not before. Good luck.

You most definitely can. And probably should, before they get a chance to abolish concurrent filing. Make sure and include a copy of your I-140 filing receipt. Good luck!!!

Hi,

What is needed for I-485 filing? Just the forms for yourself and your spouse? We both have H1b valid for another 3 yrs. so is it necessary to apply for AP and EAD? after filing I-485, can we travel with the H1B stamp?

Thanks.

Go to the link below and you will find the answer to your fisrt question.

Employment-Based Applications

If you are filing based on an offer of permanent employment in the United States, you should submit the following:

I-485, Application to Register Permanent Residence or to Adjust Status
G-325A, Biographic Information
Copy of your I-797, Notice of Action, showing that your I-140, Immigrant Petition for Alien Worker, has been received or approved by INS (As of July 31, 2002, an interim rule was published in the Federal Register allows for concurrent filing of Form I-485 with Form I-140, if a visa number is immediately available.
I-693, Medical Examination of Aliens Seeking Adjustment of Status

If your H1B is valid, you don't need to apply for EAD and AP. Yes you can travel with stamped H1B.

Thank you jify30 for your answer.

Actually I am planning to file concurrently for I-140 and I-485 after Sept 1, since it is now current for India. So far I was preparing for just I-140, now have to start thinking about I-485.

Is I-693 the form that a certified doctor gives you in a sealed envelop? I did it for myself and my spouse about 6 months ago as I thought I needed that for I-140. would that be valid? Or we should do it again. Sorry if I am asking stupid questions...

Thanks for replying!

First of all you don't need to file I-693 while applying for I-140. Secondly, the doctor will fill up the forms by himself when you do all the check ups. You just have to sign the forms in the doctor's office (Usually the doctor's office have the copies of form I-693 available, but make sure they have it when you make an appointment with them). Here's the site where you can find the civl surgeon authorised by the USCIS for medical examination purposes (you cannot go to any doctor for the examination, but only to the doctors which have been authorised by the USCIS).

Make an appointment as soon as possible if you want to file by Sept. 1, 2006. Good luck.

i beleive you shd get this done again as test done 6 months or before are not valid...it might generate I-485 RFE. Although som etest done 6 months ago might help you get it done faster this time..

it sgoing to be current from sep 1 then you have one whole month to file .....it is less chance that oct it will get retro again but yes next 45 days get it done!!!

Thanks a lot for your reply, eb1doc and jify30! It makes lot more sense now. but what about visa numbers getting over for EB1 this year as I am reading in other posts? do I have to worry about that?

Thank you all again.

What Is A#

Thanks Jiffy,
I have another question.
What is A#? my dr. asked me to bring this if available. I also need this # to complete most of the forms. From where I should get this no.
Thanks,
VR

I don't think alien number is present on I-140. It will be present on I-485 and EAD. If you don't have any A#, don't worry about that. You can file your application without this #

A number

I had asked this A number question few days back and got no response. I checked with other folks, and it could be your OPT EAD# incase you were on a F1 student visa (optional practical training). But, if you didnt, then I guess you can leave it blank.

I did have an OPT EAD# but that was only good for one year? So, I left the A# blank when I sent my I-485.
