I have a question and need some help. My boyfriend is here on an H2B visa from canada which expires june 30th, and has a company that wants to sponsor him to change to an H1B visa. He has a Bachelor's degree that is directly related to his field for the H1B visa, but we have been told that there is no sense in applying because the H1B visa cap has already been met.... but my question is, would he be exempt from that cap because he is just changing his status? We already have an approved LCA and the forms are ready to be sent, and then we got this bad news today... if anyone can help, please do. thank you!
