hi all,

Here's my situation:

I am a h1 holder. I started maternity leave earlier this year from January 2005 to March 2005. I plan to work as contractor for current company after my maternity leave ends. This means that I will work flexi hours and may not be working 40 hours a week. I may not even do any work in a month. My questions:

1. Do I need to change my current H1-B to a contract H1? Or is there a contract type of H1-B?

2. My LC was filed Oct 2004. Can I quit the current company, but tell them not to withdraw the LC, and then come back to work for the company when the LC is approved?

3. If I want to change company, my latest pay stubs was received in January, can I use those January pay stubs for H1 transfer in April?

thank you for your input,
H1 junior

There is only one H1 (Employer /full time employee rationship)
2. My LC was filed Oct 2004. Can I quit the current company, but tell them not to withdraw the LC, and then come back to work for the company when the LC is approved? If you quit you have to get another H1 or H4 to be in status
3. If I want to change company, my latest pay stubs was received in January, can I use those January pay stubs for H1 transfer in April? Yes ,with the excuse of valid reason not being in the payroll
thank you for your input,
