Change from E2 to H1b

Hi,

I am currently holder of a dependent E2 visa for 5 years but my employer is running out of business. 1) Is it possible to be employed by another employer pending completion of a H1b new visa? 2) Do I have to go back to my country in order to apply for the H1b visa.

1). No. you can not work for H1 sponsor unless you have approved H1B.
You have to wait for H1 approval(AND H1 start date).
2). if you filed H1 with change of status, you do not need to go back at this moment.
