% Chances I-485 Approval, I-140 is withdrawan in < 180 days

I got laid off before completion of 180 days after filing my I-485.

Previous company has withdrawn my I-140 within 180 days of after filing my I-485

My lawyer is planning to file MTR (Motion To Reopen)


What are the chances of getting my I-485 approval.


It has ever happened in the History, Such cases got approved. If there are under what circumstances.

Very slim chance if that's before 180 days since the rules are in black and white. Filing MTR may buy you some time but you must still prepare for alternatives such as going back to H1-B or going to Canada or going back to your home country.

I know a friend who got laid off 3 months after I-485 filing and still hanging in there with EADs. But his company didn't report his laid-off luckily.

Sorry to see you in such a situation and hope better things in your life will come out of this misfortuate.

My friends cases.

May be it is little bit different then your case..

My friend VSC, was working for X company.
140 approved in July 1st week 2001.
Company X merged with Company Y in 2nd week July 2001.
Company X was no more as of 3rd week.
His 485 docs was prepared in 3rd week with new company name in it. and applied in 4th week of July 2001.
He got layed off in 4th week of Aug 2001.
Got his receipts on the day he was layed off.
Went to Local INS (Boston on the same day) and got his EAD.
Approached a lawyer.. Lawyer said no problem..
He got another project.. was working on W2..
In May 2002 he got query.. asking for all W2's, employment letter, recent paystubbs, medical for his wife and 3months out of status for his wife in year 2000.
He responded with new company name and all documents INS asked.. and For his wife they paid $1000 fine.
Both cases got approved in 2nd week of July 2002.
