Guys,

I desperately want to change jobs
( Bongo "Guys Need Your Advice." 8/19/01 12:10pm )
but it looks like using the 180 day rule for me is risky.

I need to accept/reject the position *now* and it starts 01/01/02

What are my chances of getting my I485 approved by 12/15/01?
I think they are slim as I haven\'t received FP notice
and I fall in the SF jurisdiction and I heard they don\'t
allow you to go in ahead of schedule.

Thoughts?

Difficult to predict but ask lawyer to inquire for FP

I\'m not sure if anyone can predict with any certainity - but going by discussions in past few days, it will be good to ask lawyer to inquire for FP if filed > 120 days. My lawyer had independently (without my mentioning these discussions) offered to do it for my case (RD 4/17/01 - its like 123 days now). I\'ll keep the Board informed of outcome of inquiry.

Try to be on the safe side

1. Talk to a good attorney about this
2. Have in mind that nothing, nothing is guarantee with the INS
3. Personally, I would stay on the safe side and stick to the sponsoring employer since you are in the IT sector and you want to switch to a job in the academia

this is personal opinion and not a legal advise, but I hope that another feedback is helpful

good luck and take care

Thanks, but attorneys don\'t want to help

I offered a good attorney money to advice me
if the new job met the AC21 (180 day rule)
requirements and he doesn\'t get back to me.

Does SF allows FP before the appointment date.

My concern is when I do get the FP notice it
will say please come in on March 2002!!!
