Catch 22

Guys,

I am in catch 22.

I have just applied for my citizenship. I have been interviewing at several places in India and the opportunity has struck.

They want me to join me in 2 months time. I know it takes more than 3 months to get the naturalization cert.

What are my options? Do I have to give up the excellent opportunity that I was working for several months? Is there any way I could go to India and still get my citizenship application processed?

Thanks in advance.

Just answer yourself this: you have worked for this excellent opportunity several months; how long did it take you to get to this point? Several YEARS at the least.

Easy, if you plan to live in India for the rest of your life I would give up on the dream of US citizenship. You will have full legal rights and citizenship in India.

Tell the company you need 4 months. Sometimes they'll agree to it, even if they currently insist on 2 months. Or they'll say no now and then call you back.

If you're lucky, you'll get your interview and oath before accumulating more than a month or two in India, and the interviewer or oath officers won't harass you about what you're doing in India.

But you can't count on having that luck. Unless you get an approved N-470, you're taking a risk by leaving to work in India before completing the interview and oath.

Well you have 2 months, just apply get your biometrics done (usually within a month) and come back for the interview and oath! If they ask I would just say vacation or something, but chances are you won't be asked anything!

How can I know about the interview and oath while in India? Does USCIS send e-mail telling the interview and oath date?

Thanks.

Unless and until you sing up online at USCIS website but its not reliable at all. USCIS inform the applicant ONLY by postal mail and remember all their mails are not forwarded.

Citizenship obtained that way would probably fall under fraudulently obtained, if you accept a job outside the US for a foreign company you are abandoning US residency which would be incompatible with obtaining US citizenship. Now, as a practical matter you might still obtain US citizenship if the question doesn't come up during interview or you hide this during interview. However, that would put a lot of things at risk. Anyway, it is clear to me, either refuse the job and apply for citizenship, or forget about US citizenship and take the job. Don't you have more advantages keeping your Indian citizenship? As far as I know you would lose your Indian citizenship when you obtain your US citizenship, so you would have fewer rights in India.

You are advocating lying to an USCIS officer. That is not a good advice at all.

To the OP: if the opportunity is so good that you'll never need return to the US, why don't you take it and relinquish your green card. If the opportunity is not THAT good, get your citizenship first.

Thanks Sam99,

I am in Fort lauderdale area, will it be Miami DO?

They don't shcedule interview and oath at the same time?

My wife got her GC 3 months after me. She will have to apply 3 month later?

Thanks.

To me it appears to be a simple choice. Get the citizenship for both you and your spouse. Say it takes a year from today, since your wife got GC 3 months after you did.

Please note that the job you are getting is not the last job available to mankind. You can always find a better job, but citizenship is a different ball game

Hope this helps

I too would advise you to get the citizenship completed before taking up job in India. I tried to do this myself and was able to negotiate with my US employer to work from India for a few months. I had my mail checked by a friend and I came back for Interview, 2nd FP and the oath. That opportunity from the employer gave me time to get things set up in India and decide whether moving back to India was a good idea for us.

You can always get another job. But if you don't take US citizenship and decide to stay back in India, it may be very hard to come back and work in US if things don't work out long term. Work visas are already getting hard to get and God knows what will happen in a few years.

It might be Miami DO as there are 2 new offices in Miami area

No, they do not schedule interv and oath at same time. They will send oath letter n445 within 90 days after the interview.

Yes, your wife will apply 3 months later

It will get denied and you might or might not lose your money depending on whether they make you go to an interview or they reject your application upfront.

I got my greencard in 1 yr start to finish-labour to stamp in passport. The card came about 4 months later. I know someone who got it in three months-those days, you could use another's labour and file I140 and I485 together or some such. Don't know the exact details-except he got it in three months.

The priority date is now behind my date of application.

If you loose this opportuntiy especially over a few months, the chances of getting another greencard and citizenship are close to zero in today's world. Even if it takes six months, get it done and over.. Then you can leave . But your choice.

Who knows in a year or two, they may make the n400 process as slow and difficult as the greencard process. Why take the risk. I remember then my brother made the same mistake. Didn't care for a greencard-it was so easy then-just final stages and left. Now me and my parents are here and he is stuck there. It is one thing if you have years to wait for -but a few months?
