case transfer

Our I-485 cases have been transfered to St Albans, Vermont service center from Texas service center. The message says that local office will a send a written decision as soon as processing is complete. According to customer service rep the transfer is correct. wanted a second opinion from you guys. The questions are,

1. I live in central PA and do you think the transfer to St Albans is correct?

2. Has anybody been in such a situation?

I was in a similar situation last year. TSC transferred my case to a local office in Miami. I am from Atlanta and was very suspicious of this transfer. When I called the TSC they kept saying that your case is in Miami. When I told them that I am from Atlanta and that the case should not be in Miami, they told me to get in touch with the Miami office. I was never able to get in touch with them. Finally after 2 months of the transfer I pushed my lawyers into filing an inquiry. My lawyer got in touch with an AILA representative and after 4 months TSC finally took my case back. I never received any notifications about my case being back at TSC. The AILA rep just confirmed that it was there. Finally I received FP notices from TSC and just last week they approved my 140.

I suggest you ask your lawyer to get in touch with an AILA rep and find out what exactly is going on here. Do not waste time waiting for something to happen.

In this case the file was NOT transferred to the local office. St. Albans, is the Vermont Service Center (VSC). Since paguy lives in Pennsylvania, he technically is in the jurisdiction of VSC.

The transfer is correct, but a rare occurrence. (I assume your I-140 was approved in TSC?) Most people get approved at the service center where their I-140 was approved, regardless of where they live, but some few people get transferred to the service center that has jurisdiction over where they live.

Where was your I-140 approved? TSC, or VSC?
Can you post the actual transfer message that you see online? (you can leave out your case number of course)

On March xx, 2005, we transferred your I485 Application to Register Permanent Residence or to Adjust Status to an office in VERMONT SERVICE CENTER for processing. That office has jurisdiction over the case. They will send you a written decision as soon as processing is complete. You should receive a notice informing you that your case has been transferred to a local office. Please call the National Customer Service Center at (800) 375-5283 to receive information about local office processing times.

Message in notice of action recieved by mail:

This is to notify that we have transfered the above application or petition to the INS office at:

Vermont Service Center, 75 Lower Weldon Street, Saint Albans, VT 05479-0001

We transferred this case because the record indicates that office has jurisdiction over the case. That office will notify you of subsequent action taken on this case. Any further inquiries should be made to that office.

My question is,

1. Is my case transfered to VSC from TSC and NOT local office? My 140 was approved in TSC.

At this point, your case has been transferred to VSC. VSC may approve it, or they may decide to transfer it to a local office close to where you live.

The good news: Your RD in TSC is Sept 2002. Now that your case is in the VSC service center, it should get processed a little faster in theory, since the processing date at VSC is currently March 25, 2004.
