Hi All,

What is the criteria for transeferring case from one Service Center to another or to District offices?

I am afraid that my case may be transefferd. I had my Labor doen from MA and filed I-140/485 in Oct 2002 from MA, I-140 approved in November 2003. I moved to CA in March 2004 and filed AR11. I am not sure if My case will be transferred to CSC or any District office. I am afriad that transfer will only delay the processing. Any thoughts?????

thanks,

It is rare for a case to be transferred from one Service Center to another if the original SC had legitimate jurisdiction in the case, which yours did since they took in (and approved) the I-140.

Typically cases are transferred when there are job description issues with AC21, a marriage close to the I-485 filing date, or general randomness.

marriage close to filing 485

Thanks TheRealCanadian!!

Any details about the logic why case will be transferred if marriage was done just before or after filing primary benefeciary's 485 case?

thanks for your input.

There may be the suspicion that the marriage was entered into primarily so that the spouse could get a Green Card.
