Case Status Controversy. Who should I trust

My case is a concurrent filing case. Over a year ago, I remember the attorney asking for documents to prepare for an RFE on my I-140 case. Later, my I-140 was approved according to the attorney. Somehow, the on-line status of my I-485 case changed to "response to RFE received on 02/11/2003" and has stayed that way. I always thought it is referring to that RFE for I-140.

But today when I visited the Dallas District Office regarding the I-485 case, the officer down there told me that her system shows that an RFE was sent ON 02/11/2003 but no response has been received. She insisted that she trust her computer screen more even after I told her about the on-line status.

How should I interpret the two obviously disagreeing messages? Has anyone heard or had any similar experiences? Any advice would be appreciated.

If the RFE was generated over a year ago and not responded to, the case would have been denied long ago. My gut tells me that if the online status says that the RFE response was received on the same day she thinks it was generated (and you know the RFE was generated before 2/11/2003) I'd trust the online status.

She might be mistaking the RFE sent and RFE received codes.

Patiencelesstx, we have seen in past the online status message is not 100% reliable.
as per the officer's computer screen message, since we all don't know much, we have to go by their word.

what did your attorney tell you today when you informed him/her abt today's events?
Sorry to hear this mess for you, I suppose it must be a shocker for you too.
I hope things go smoothly for u.

RealCanadian raises a good point though. your case is not yet denied.
And you too didn't receive any RFE by post.
So if at all, they had sent a RFE you can file for some form for Service Error.
A forum member in the past filed for Service error and in fact it ultimately worked to his advantage.
His id is 'wasamericandesi' and he got approved in Dec.

Is the date of the RFE really 2/11/2003 and not 2004? I think it is highly unlikely that CIS would let more than a year go by without a response to the RFE. Their normal practice is to reject your case if a response has not been received within 90 days.

The only RFE that I know of was for I-140. I don't know the exact date. But it was issued either Dec 02 or early Jan 03.

I have never heard from my attorney about an I-485 RFE other than my on-line status says so. I have never received any RFE in mail regarding my cases. Should the attorney and I both receive a letter if there is an RFE?

I have pinged the attorney. Hopefully they have an answer to this mess.

Thanks to your input. (I could not tell how "wasamericandesi" filed his complaint though)

any update in your case, patiencelesstx.
what did the attorney reply back ?

if you need to get in touch with wasamericandesi, then let me know ( you know how to get hold of me).
there is a service error form... do a search here for service error,
maybe you will find the form somewhere or else we can ping
wasamericandesi.
