I went to pick up my results today from lO for my Asylum application. The interview lasted 2hours and was of the opinion l had done well so am very suprised and shocked. The reasons for denial are on the basis of:
Material inconstistency between my testimony and application and or other evidence.
Material inconsistency within my testimony.
Brief explanation: my political activism was found internally inconsistent and inconsistent with other evidence.
Harm suffered was found internally inconsistent and inconsistent with other eveidence.
Right this is what IO stated as my referral reasons to IJ were l am supposed to go in March 2009. I need help on how l can prepare for the hearing and will the Judge use the report from the IO or it will be like a new hearing and what happens on first hearing and how can l speed up the process so that l can get to trial on first day.
What evidence is crucial at IJ and will l be told and shown the inconsistencies by the trial attorney before the case starts in court for me to clarify issues. I come from Iraq. What are my chances at IJ.
 
GET AN IMMIGRATION ATTORNEY. People with immigration lawyers win 35%+ of the time in court. People without attorneys win 7% of the time.

You cannot have your individual hearing on the first day. You just can't. The system just doesn't work like that. You have to have a calendar hearing first to schedule you for an individual hearing date.

Hi Stanly, since u hv been referred to IJ now, when u appear before IJ for the 1st time u will be getting another date for next hearing. 1st hearing is called master calender hearing. Its better to go with a lawyer. Nothing will be discussed abt ur case on that day, so need not worry abt ur first hearing
 
I just had a Master Hearing (the 1st one) yesterday...Was worrying about it but nothing special. Our lawyer was on the phone and IJ asked some questions like my name, confirmed the information when I came to the US thats it. Ane gave me the copy of notice to appear for an Individual Hearing (where you will be cross examined). You definitely need an attorney.
