Yesterday, I sent a message to the congressman with regarging my I-485 case (WAC02134xxxxx). They helped me send an inquiry this morning, as a result I got the following message:

-------------
On December 16, 2004, we transferred your I485 Application to Register
Permanent Residence or to Adjust Status to our office in SAN FRANCISCO,
CA for them to schedule and conduct your interview. Scheduling can take
several months. Our office in SAN FRANCISCO, CA will notify you when
they schedule your interview or take other action on your case. If you
need further information, please call the National Customer Service
Center at (800) 375-5283.
---------------

I couldn't think about even one reason that the INS should transfer my case to SFO for interview. I stayed with the same employer.

Looks like another one to two years ahead

Question: Can the congressman help me push the SFO office to schedule interview?

sshen,
If I were you I'd definitely write the congressman and express my extreme disappointment that the case will now take even longer to adjudicate. You should explain in the letter how the JIT is way past beyond your date, how others filing much later are getting adjudicated and how much of an emotional strain this is.

zoro.

sorry to hear that

are you sure the transfer was the result of congressman's inquiry?

sshen! I think it does not make sense.
You sent inquiry to INS today and it affects immediately!!! No, it may take over 2 weeks. And, the case for interivew is chosen randomly.

chankuk is right. The processing dates posted on the web site for the local office are for Family based I-485's only, not for employment based I-485's, although it doesn't specify that very clearly. Wolfman tried to get help from a congressman when his case was transferred. Its seems that they can provide little to no help once the case is trapped in the local office. The local office is like a banana republic when it comes to employment based cases. They have no accountability, and they deny responsibility since they will tell you that employment based cases are the jurisdiction of the service center. The cases are "dumped" on the local office, to reduce the backlog at the service center, and so the local office sees them as their lowest priority. In Miami for example, out of 6 officers, 4 of them did family based cases full time. The other 2 did employment based cases part time, and family based cases the rest of the time. They have no requirement to provide a processing date like the service centers, and so they could theoretically keep your case hostage indefinitely without any way for you to complain to any government official that your case is taking too long. "Too long based on what?", they would ask. There is no current processing date for your type of case for you to base this complaint on. They will randomly process your date by what seems to be a quasi-random average between your RD at the Service center, your TD at the local office, your RD at the local office, and you PD. Essentially its unpredictable as to when you would have an interview, and there really isn't an easy way to get it done faster.

The good news, is you'll eventually get an interview, and if everything goes well, and you're name check has cleared, you'll get the passport stamp at the same time.

I've been in your shoes too.

Chankuk,

USCIS didn't not change mine LUD when they send the FP or when they received FP result. Looks like they are trying to compensate by changing your LUD instead of mine. Same thing happened with curiousgeorge. He got 11 welcome letter and some people in forum didn't. So I see a pattern..... Ha Ha ha
