My Case was approved using CC last week at NSC.

485 RD (Spouse) : 8/2005
485 AD (for both): 9/2006
Applied for CC(by my attorney) in Feb'06 to be charged to Saudi Arabia(Wife's country of birth) instead of India.
We both are from India.
No LUD's before approval.

Congrats!!!

zoujo, How long it took after you requested CC? Do you the format, how you requested CC? I've to request CC after my PD become current. Thanks.

Thanks Skp

It took 7 months after i applied for CC. We didn't had any form at that time. My attorney just sent a letter to USCIS.

Recently I saw CC Form here in one of the forums:

CC using spouse's place of birth?

Hey Zoujo, congrats on your smart move and the approval. My wife was born in Kuwait but we're both Indian citizens. However, I'm the primary applicant. Do you think we qualify to apply under CC? If so, how tedious is the process? How much did your lawyer charge you for this?
Thanks.

Using CC

Noops,
CC Process isn't difficult. You are eligible for CC.You or your attorney has to request USCIS to charge your application/case to Kuwait instead of India.
My attorney didn't charge me anything extra, even though I filed CC long after I had filed my 485.
We have seperate forum for CC:

Using Cross Chargeability

******************************************************
We didn't had any letter format at that time. My attorney drafted a letter stating that my case be charged to Saudi Arabia, instead of India. He had written it in bold on first page. Make sure you include both Alien numbers.

We also submitted my wife's birth certificate translated copy in English.

If I had been in your place I would submit my CC application (thru atty or own) twice just to be sure that I'm not retrogressed Applicant.

I assume, since this is the last month of fiscal Year 2006, they are clearing cases like mine...again this is just a guess.

Good Luck
