Hi,

I have a question to ask...I have applied for 485 and am in the process of moving to a new company on that company's H1. I wanted to know if I could continue my green card processing with the old company? What happens if I get a query ? I have heard that INS usually asks for a recent paystub ...What do I do if by that time I have already moved to the new company ? Will my green card be rejected ? or can I continue saying that this is 'for future employment "?

Also can I switch to the new company based on the receipt number of the 485.. I know that after 180 days one can move based on the receipt number...But can I move with the receipt number before 180 days ?

Please let me know if anyone has any input on the above questions..as i'm in a quandry as to what to do....

Thanks a ton,

Arjun

U need to respond to INS 's queries with new employer only if your 485 remains unadjudicated for more than 180 days
:- is the convenient school of thought....
What are U going to do otherwise???

Hi Jaxen,

Thanks for the reply...Well, I don't know as to what I'll do if such a scenario crops up...I have heard that in these cases I could tell the INS that I'm carrying out my green card processing with my old company with the intent of future employment ......I think that should work ....Any ideas on that ?

Also, the paramount question is ...Will my green card processing suffer or can it be rejected on these grounds?

Pleas elt em know if you have any information on this...Thanks a lot......

It is interesting!
Iam not an expert but I think it's logical to say that in your case, it's not wrong if the 485 is continued to be processed as a future employee.
First of all, after I-485 is applied how does INS ensures that you are with same employer or switched your employer. It may be a dumb question, but will you please explain this.
