I am a Canadian citizen living in the united states. I came here legally in Febuary 2009, I am only overstayed by about 3 months. While down here, my boyfriend and i have decided we want to get married. What is the best process to go about doing this? Can we get married and then apply for a change of status? Or do we have to do the fiance visa first? IF we can get married first how do we get married without me having an ssn?

Get married, then file for AOS(adjustment of status). You don't need a SS# to get married....

You will have your GC in about 4 months.
 
Being Canadian, I assume you were not given an I-94. You can actually go either route, AOS or K-1 route. A Canadian's overstay does not start until he/she is told by an immigration official. A rare case where lack of I-94 is actually beneficial.

But when i search marriage laws in both KY and NC it says you have to have photo id and a ssn number to get married all i have is a candian passport wont that be a red flag and they say they require an ssn?
 
There are 48 other states. Marriage regulations are a state level affair. When I got married as a Canadian citizen in NY, there was no SSN requirement for example.

I'm from Alberta. Moved to Miami in May, got married in June without social or drivers license. I just got my 2 year green card two weeks ago. File from within the US. Its easier.
