Canadian travel to China need AP or return stamp?

Here is my situation:

I am a Chinese born Canadian citizen and currently work in the US on H1 status (still valid for 1.5 years). My I-140 and I485 had been submitted concurrently during the July/Aug 2007 turmoil. both are still pending. Now I want to travel to China and back to the US. There is no H-1B stamp in the passport but I do have a H-1B approval notice with an I-94 in hand. AP and EAD had been applied, approved long time ago but never been used and now all expired.

Guru: do I have to have an AP to travel? If not, do I have to go to US consulate to get a return permit or not? Has anyone traveled back without any issue?

Thanks in advance!

TheRealCanadian,

So I do not need an AP or a return permit. Just present the H-1/H-4 approval notice even I fly back directly from China. If that is true, wa hooooooooo!

Keep in mind that the above advice is specific to you because you are a Canadian citizen. It does not apply to other nationalities. Other readers of this thread (non-Canadians) should be aware that they would have to obtain a new visa stamp before returning to the US - or an AP document.
