canadian spouse's GC

hi all,

i just wanted to get some feedback from some of you about my situation. i am an american who married a canadian in the past year. while waiting for my canadian papers, i stay with my husband in canada most of the time, only going back to my parents house for a few weeks at a time so that i won't overstay six months in canada.
however, i would like to sponsor my husband for an american greencard (using i-130), because we'd like to live there eventually one day. my questions are:

a) i know i have to file an affidavit of support, however, i do not work and my husbands supports me and himself very adequately. what should i do?

b) it's been almost a year since our marriage, would this be looked down upon that i'm applying so late for him?

c) if i do get my canadian permenant residence card before his papers go through, should i continue to only visit canada and legally live in the US?

d) what do i have to be physically present for during the petitioning?

that's all i can think of for now. any suggestions or comments or tips would be very much appreciated. thanks :)

I am a US Citizen married to a Canadian Citizen too!

I don't know all your answers here is what I can answer for you though-

1. You will need a co-sponsor (I don't work either and my mom is the co-sponsor for support)

2. My husband and I just filed for his GC in July. We have been married since August of 2003. We had to save before we could file.

3. I have no idea

4. I dont know what you mean by physically present. But you will need to be physically present for the interview(s)

btw, i noticed that you filed other forms in addition to the I-130.. i'm sorry for asking, but why the I-131? do canadians need travel documents to come to the US?
 
By far the biggest issue is if you get a GC for your husband, how are you planning to keep it if you both live and work in Canada?

what options do i have then, if i'd like him to have a greencard on hand so we could one day move to the US?

The green card is not a "free pass to the US (cross border card)". It is a Permanent Resident Card. So when you do, decide you want to move back and live in the US, THEN and only then, apply for his GC. There isn't another way. :cool:
 
PraetorianXI, thanks. my ignorance on this subject must be quite evident. i was just told to apply for my husband by relatives who probably thought canadian/american were almost the same thing. :-P

anyway, i guess i will have to wait until we decide to move permanently to the US. though i'll be honest, the thought of going through this process when time (packing, moving, job hunting) might be an issue is a total drag.

Yes. The only exemption is if they are traveling as temporary visitors. It happens to cover 99% of the Canadians that come here, but once you have a Green Card petition in the works or you are coming here to work or study, you need papers.
