Wrong Info (H4 + Canadian PR) will not work

Yes , you 'll need a visa to enter US ( H4 if your spouse is on H1B ) - Just keep extending your H4 when your spouse extends his H1.

Its OK if you stay and work in Canada ( Canadian PR + H4 ) and your spouse ( Canadaian PR + H1B ) works is the US and you keep vsiting each other.

There are however, 2 issues to be taken care of ( apart from minor questioning at the time of crossing borders ) :

1. taxes : you 'll have to start filing tax returns in both countries. US- Canada tax treaties will save your spouse's income from double taxation.

2. 3 year limit for your spouse and kids canadian PR - They 'll have to be inside canada every 2 out of 5 years ( or count 730 / 1825 ) days else they lose their status.

(H1 + Canadian PR) is fine
(B1 + Canadian PR) is fine for dependants

(H4 + Canadian PR) will not work

She needs to change H4 to B1.

You are wrong and "air_Canada"'s previous post is right. H4 + cdn PR is possible and that is the MOST PREFERRED status in the given scenario.

When your spouse is working on H1 in the US, you will be granted a H4 status.

Your statement is probably based on the general logic (H1/H4) and is not related to the knowledge of the immigration law.

My friend's wife had problem with H4 crossing US border with Canadian PR card last weelend. US officer said H4 visa is not right if you live permanently in Canada and needs to be changed to B1.
