Canadian Landed Immigration and I-485 approval together

I-485 approval and Canadian Landed Immigration together

I had applied for my green card and canadian immigration in parallel. I recently got I-485 approval and also approval for landed immigration in canada. Canadian consulate is now asking for my passport within 30 days to stamp it with immigration visa.

Now my question is can I get both, since I don't want to get into the situation of deciding one over the other right away ???

If I can, does the order, in which i get them, matter?? that is

* Should I get canadian immigration first, land in canada, get my SIN#, bank account etc. and come back to USA on I-94 ??
--------- OR --------------
* Should I go to local USCIS office first, get usa immigration visa stamped & then send my passport canadian consulate?

* If I do the later one first, could there be any problems landing in canada & coming back with us immigration/green card stamp ???

* Would canadian consulate stamp immigration visa in the first place when they see usa immigration stamped ???


Please advise.

Canadian and USA green card

Dear Nazimn,

You are entitled to have both green cards at the same time. You may want to get USA green card first and the go for the Canadian.

But it will be difficult for you to maintain the status of the both green cards in the coming years.

1. My parents & brothers live in Pakistan & eventually I want them to settle in Canada or USA. The reason I want to keep USA Green card is because I have a job here and want have a future here with my family. The reason I want to keep Canadian Immig. is because sponsorship works faster in canada, so eventually I want to bring my family closer to me.

2. I know its difficult to maintain residency in two countries and I may most probably have to end up deciding in one or the other, but I don't want to get into that situation now.

My timeline is 20 days now. Filed US GC in april 2002 & got I140 & I485 approved in jan 2005. Filed Canadian GC in oct 2001 & got final decision in jan 2005.

Thanks, thats what my attorney suggested. He said I can go to local USCIS office without passport and with extra passport style photo which they'll stick the photo on I94 & stamp it. I can use it as temp card until I get the acutal PR card in mail. Also, I can send the passport to Canadian Consulate for immig. stamping. Once thats done, I can go to canada, land & come back to US on temp gc.

About maintaining residency, yeah I agree its difficult but then I'll have more time to decide.

What do you say????????

Hi nazimn,

If you live in USA, how can you sponsor your family based on canadian PR?

Can we sponsor our family to canada while living in USA?
 
Here is what might be an option, only if you work close to the border e.g. Windsor-Detroit:

* Get both the immigrations (USA & Canada)
* Move to canada
* Get commuting green card at the border, so that you can cross the border & go to work.
* Sponsor family when eligible
* Go back on resident status in USA

The only downside is the number of years spent living in canada (comutting green card) wouldn't count towards applying for USA Citizenship.

This is something that my attorney suggested.
 
I am in similar situation as well (have US Green card and will be landing in Canada for a few days to preserve Canadian PR). I will come straight back to the US after spending a few days in Canada.

I wanted to check if anyone else who had gone to Canada on a PR had trouble with the INS when re-entering the US on their greencard.

I believe, one can not sponsor but the relatives can claim points if they are applying on their own. Sponsorship requires T4 slip (US w-2) info and other income verification.
 
You can always file taxes in canada as long as you are resident there, regardless of whether you work in canada or USA. In case you work in USA, you'll need to file USA tax returns too.

But that again is something at a laterr point. First thing is to get both. So the question, for those who happened to get both approvals simultaneously, is: In what order should both be obtained US immig. first then canadian or vice versa ??

So to answer your question. It really does not matter which one to get first. Because they really do not care which one you have first. It is your personal decission adn one GC approval is independent of the other and it is your choice which one you are going keep in te long run...
 
So based on your opinion, if say I get green card first and then go to canada for the purpose of landing, the canadian immigration officer shouldn't have any problem with that, resulting into something drastic like revocation of landed immigration.

Similarly, US immigration officers shouldn't give me any trouble coming back to USA.

No not at all. Because it is upto you to maintain residency and wherever you maintian residency where you will get citizenship. When I applied for CA, I had to prove my legal status in the US which was a receipt of 485 so what does that mean. I was going there to visit in August and the consulate lady asked me very politely as which one will I give up if I get both GCs the same time but it was only when she almost had my visitor visa approved...
