I am Canadian citizen and completing my residency training in June 30. I have applied for the waiver and current online status shows "Pending" at DOS website. The last update was in April 28, 2009 when they received State Health Department recommendation letter. I am little concerned as my DS-2019 is being expired in June 30 and I will be out of the status after June. I wonder should I stay here till July 30 (utilizing grace period) to wait for the waiver and complete the whole process of H-1B OR leave the US after completion of my training in June and come back on visitor status for follow-up of my case? I am not sure how long DOS will take to approve my waiver, I am hoping for the best and patiently waiting for their Favorable Recommendation. I will appreciate Any suggestiuons, advise, or recommendations. Thanks:)

Here are my time line for Waiver Process:

State Application Cover Letter Received April 28, 2009
Employment Contract Received March 19, 2009
Curriculum Vitae Received March 19, 2009
Form G-28 Received March 19, 2009
Foreign Medical Graduate Physician Statement Received February 19, 2009
Fee Received October 27, 2008
Form DS-3035 Received October 27, 2008
Form DS-2019 Received October 27, 2008
Passport Data Page Received October 27, 2008
Statement Of Reason Received October 27, 2008

To stay the grace month or not is up to you and will not change any thing in your situation. You can stay without job and at the same time no guarantee that the waiver will be done. Some cases will be approved in few weeks, others will stuck for ever.
