Canadian Citizen changed from TN to L1-B ( approved ) daughter is on TD , can we change her status at POE from TD -> L2 ?

Hi Team,

myself and my daughter both are canadian citizen,

I have just got approval for my TN -> L1B , my daughter is on TD ( based on my previous TN status) , since now i have i-129 approved for L1-B and planning to do my POE from Niagara with my new L1B ,
is it possible at the same time my daughter visa also converted from TD to L2 ?

So, you do not need to go to border to do anything for your L1, since it is approved and you have an I-94 (very common mistaken advice from lawyers),
But, your daughter does need to get an L2. Too bad the firm didn't add that to your L1 petition. Another error by your firm's legal team.

You might want to keep a (closer) eye on how they do things for you in future.
 
Yes, your daughter can either file I-539 for Change of Status to L2 inside the US, or leave and re-enter the US on L2 status based on her Canadian passport and your L1 petition and proof of her relationship to you.

Actually my daughter is instate with me and Company's law firm file I-539 as status change from TD -> L2 for her with my L1 application of I-129 , Now my I-129 is approved but I-539 may take 12 to 15 months to change my daughter status from TD->L2.

i was thinking instead of waiting for I-539 status changes , in this month i have some personal work in canada so plan take my daughter with me with her canadian passport, Birth Certificate and my L1 approvals and reenter her admitted as L2 , hope that is possible ?
if its possible then its fastest option for her from TD to L2 .

You can have her leave and re-enter into L2 status if you want. But there is no downside to doing nothing and just waiting a long time for the Change of Status. She can still stay in the US all this time.
 
Agree with newacct. Only go to border when convenient. You would need to pay for two covid tests and/or quarantine in canada. Not much fun.
