I am Canadian citizen and my wife is American, we got married in April’01, she filed 130 petition for me in Aug’02. Yesterday (June 2’04) we were informed that our petition has been approved, it’s still in mail, so haven’t looked at it yet. Currently, I travel to US every week for business reasons on L1 visa and return home (Toronto) on weekends.
My questions are:
1. What are the next steps after approval of petition
2. I believe I should be filing AOS (485) and EAD (765) plus other forms?
3. Once I file AOS and other forms, can still I travel back and forth, I know I can send 131 with these forms, but I am not sure how long would it take to get 131 processed since I travel back and forth every week.
4. My wife does not work, but I am employed and filed taxes last year both in Canada and US, how should I handle this sponsor requirements
5. I am planning to switch employers, I can have offer (dream job) in hand provided I have EAD, considering all this Where should I be applying for AOS in Canada at US embassy or from within US

Thanks very much for your help

Well actually from my experience your wife should be filing here in the US for your AOS, as far as her not having a job, thats a different story, you will need to have her or someone related to her to sign an affadavit of support. Simply because she will be filing on your behave, I just went through this with my husband. I had to sign an affadavit of support for him... hope this helps a little .. Just my advice
