Can you re-enter the USA with Maiden Name on Passport?

Is there a new rule from the INS that a spouse holding a passport in her maiden name cannot re-enter the USA unless the passport has the husbands name endorsed?

I have just been told that since my passport is my maiden name and also my name isn't endorsed on my husbands name, I will not be allowed to re-enter the USA if I travel.

Do I really need to change my name on my passport? What happens to my H1-B in that case?

I would appreciate any information as I have to travel soon.

You can use your maiden name, even after marriage. Since you have H1 there are no issues.

I have heard rumors about H4 applicants, have to come across one case where H4 stamping was rejected because of the last name issue yet.
