If you file a petion in a timely manner and have the INS receipt, even I 94 is expired, you are under status until your case is denied.
You will not get arrested.
Once denied you get out of country immediately, and you will not get barred for this reason. But keep copy of the petition with you when you come on diffrent visa to US again
