Hi Gentlemen,

The question is:

If one files for I-140 and I-485 together, and If his I-140 gets approved, while I485 is in pending, can he file for work permit?

If he can file for work permit then can the work permit be approved before I-485?

Please let me know, I will be really greatful. My email address is zeeshan673@gmail.com

Warmest regards,

Zeeshan

Yes, you are eligible for EAD(Employment Authorization Document) based on pending I-485 and you can apply it yourself. Official USCIS line is that EAD should be issues within 90 days so they get approved anywhere in that time.

You can file for I-765 (EAD) and I-131 (AP) concurrently with your I-485 petition. After the I-485 is approved, the EAD is pointless because you are fully authorized to work - the EAD becomes invalid after the I-485 is approved. If you file for EAD after I-485 approval, they will deny the EAD.
