Hello all,

Have scenario like this and appreciate your inputs on this based on practical things you saw.

1. Get NO OBJECTION certificate from my Indian government
2. Apply to Indian Embassy to get waiver using that certificate
3. Apply to Dept. of Labor US

I am on the way to apply my J1 Waiver with Indian embassy. Before applying that, would like to know if I can change my job to another university or I need to apply the J1 waiver again if I moved to another job? If later case, Do I need to start from step 2 again?
Heard from some lawyer that no need to get the J1 waiver again if you got it using NO OBJECTION method.

Appreciate your inputs. Please don not pass theoretical answers.

Hello, Yes it can be changed but a lot has to be explained.

1. It is possible to change employers during the 3 year J-1 visa waiver period, so long as the following may need to be demonstrated to the satisfaction of the US Immigration Service:

1. Extenuating circumstances based on hardship exist
2. The hardship was beyond the physicians control and unforeseen
3. The physician was able to obtain a new employment contract for employment in another under-served area for the duration of the 3 year work obligation
4. The State Health Department has concurred on the physician's request to change employers

2. The US Immigration Service decides these requests to change jobs on a case-by-case basis. Generally the following situations have allowed clients to obtain approval for changing waiver jobs:
1. Closure of the medical facility
2. Breach of contract by employer
3. Spouse of physician forced to move out of state for residency/fellowship training
4. Urgent health / personal issues
