Yes, you can. You apply for I-140 and then for consular processing. But the interesting question is where do you mail it to. NSC or TSC? I haven't found any rules about that. Of course you want to try to send it to TSC, instead of the No-Service-Center.
On a related topic I was wondering whether I can fly to my home country and submit a I-140/NIW to TSC. I work in the US and my place of employment is under the jurisdiction of NSC. But while on vacation I would have a foreign address, so maybe it would be ok to submit to TSC? Any ideas? It just doesn't look like NSC will ever process NIWs. At the current place my turn is mid-2012.
