Can Spouse use AP and I use H1 at POE ??

Hello all,

Please advice. I am the primary filer for 485 and my spouse is the beneficiary. We are planning to go on a vaction using AP. While coming back into the country, I want to do it using H1 (valid till june 2002) and my spouse has to use AP as his H1 will expire tis month.

Do you see any problem in him using AP and not me. Thanks all:)

Thank you. I recieved 3 copies of AP. Which one should be used at POE ?. And i heard that airlines will need a copy of the AP. Is this true ?. Thanks...

I\'m not sure about the 3rd copy.....Use the one that says "To Alien"(at the right bottom) at the POE.....I just used AP y\'day to come back and the airline did not take any of the copies....But be ready to show it when you check in as they\'ll look for a valid visa....
 
Take all of those AP copies

Present them all to an INS officer and Sometimes he/she will keep one of the copies and return "To Alien" copy to you.. or in other cases he/she might return all of the copies back to you (like in my case, he returned them all back to me!)
Airline will ask you for a copy of AP to check your permit but they CAN NOT keep any copy!! You only present a copy ("To Alien" copy is fine) to them to check and verify your re-entry permit. They are NOT supposed to keep it. Its just like when they check your visa- they check your passport to verify that you have a valid visa (and in this case, your AP) to enter the US and then they issue you a boarding pass.

I have recieved only 2 copies, 1) to Alien and 2) To transporter.
