Can Spouse use AP and I use H1 at POE ??

Hello all,

Please advice. I am the primary filer for 485 and my spouse is the beneficiary. We are planning to go on a vaction using AP. While coming back into the country, I want to do it using H1 (valid till june 2002) and my spouse has to use AP as his H1 will expire tis month.

Do you see any problem in him using AP and not me. Thanks all:)

Of course you should check with your attorney. I personally think it\'s ok cause my attorney told me that I can use either one when I have both AP and H-1 Visa, although I don\'t have my spouse traveling with me...

I had a similar situation!! I used my H1 and my used AP at POE!!!

We did not face any knid of problems. there will be a secondary check for all the persons using AP. So my wife had to goto for the secondary inspection, where they checked her 485 details etc.

Your H1 will not get invalidated if your spouse uses AP. See murthy chat for more info. CKjagdish do not post incorrect info.

I remember having read somewhere on murthy chat transcripts, advising all the family members to travel on either H1B or AP. Please go through the old chat transcripts on Murthy.com.
