Can someone travel into US while waiting for H1B approval ?

Hi,

One of my friends will be working from Canada with a Canadian visa since the H1B quota is over for this year. His lawyer is telling him that he cannot travel into US when his H1B application will be pending with BCIS. Is this true ? Are there any risks if he travels inside US when his H1B application is pending with a different visa like visitor visa for work related purposes.
