I have a H1B question. I know that this is not the right forum but I suspect that everyone on this board is an immigration expert by now (this is also the most active forum).

My H1B is just about to expire the first 3 year limit and I want to renew it for another 3 years (total 6). I work for the same company and nothing has changed in respect of employment. My question is can I still continue to work if my H1B expires BEFORE it is approved for another 3 years or is the H1B receipt notice enough to work pending approval?

The new law regarding H1B extensions is a little ambiguous regarding this situation. The law specifies "New H1B Petitions"

I think the new law on new H1s will apply to extensions as well. Come to think of it, the law should be less stringent on extensions than new applications.

From Rajiv Khanna\'s FAQ:

Q55 My H1-B expires in July 1997. When should I file for my visa extension?
A55 You should file your request NOT EARLIER than four-six months before the expiration. I would advise filing the request three months before the expiration.

I think you should be fine as long as you file for extension BEFORE the expiration date. As an example., in my case it was applied two days prior to expiry. (Not to the mention the unscrupulous lawyers). Such a scenario of apply in the last few days of expiry, keep your courier tracking #.
