Can somebody help me to understand this issue "sending FOIPA no response"

I sent my FOIPA to FBI on early of February, until now i haven't get any response from FBI and my name check still pending.
Can someone tell me how long normally to get response from FBI for FOIPA request?
Do you have some idea what's this problem?

It takes around 3 months to get a response for FOIA. To receive an email from FBI, it could even take upto 5 months. Just my few cents.

I understand that the name check query by email will take upto to 5 month, but i am not clear the one you said it take about 3 months to wait for response, Are you talking about the FOIPA sending to FBI or the FOIA sending to USCIS?

Did you sent FOIPA TO FBI? If so, how long did you get response?

Hi

I sent a FOIPA request about 2 weeks ago and got a reply last week by mail. It says no records found...but name check still pending from Dec30 2004. Should I fax Mr. Hardy a request to expedite and will they expedite it?. Any suggesstions/experiences?

It seems the FOIPA request not take too long to get response. Only take two weeks you get the response from FBI. I don't understand why I hear nothing until now almost one month for my FOIPA request.

It is good to know you get response from FBI. I personally think you can do that to send a expediate to FBI/USCIS.

Hope someone in this forum who had throughed this name check process and have more experience can give us some suggestion and useful information.

In my case it is really unusual delay for my I485 case.
I am in EB2, 485 Nd: 4/10/03, still waite here for name check. It is pending for 2 years. Sent FOIPA, no response, sent name check request, no response.
Congressman is not helpful. I don't know what is going on there.

What can i do?

We have exactly the same situation. My 485RD is also April 10, 2003. I was told by VSC that my name check request was initially sent to FBI in June 2003. However, from FBI's feedback (it took me five month to get the feedback). My name check request was not received until January 2005. To make it worse, my wife pass the security quickly while my case started its pending at FBI.

I have sent FOIA request in mid February and have not received any response yet. I called the FBI FOIA phone number, Debbie answered the phone (I usually only got her voice mail) and told me very impatiently that it may because I have a pending name check. While name check and FOIA share some information, the information needed by my FOIA my not be available because of pending name check. Honestly, this reason didn't sound that convincing to me. I faxed another FOIA request to them after the talk. It has been one week after I sent second reques. No response so far.

Three weeks ago, I sent an expedite request to VSC and told them it's soooooooo unfair and hope they can sent expedite request to FBI. NO RESPONSE at all.

From your login name, it seems that you are Virginia resident. I am a Virgina resident too. What a coincidence! I don't have good experience with local Congress man either.

It is very diffcult for me to keep sanity when my name check just STARTED its pending at FBI while case one year after me got approved.

Life is unfair. Have to bear with it.

Thank you for sharing your experience with me. I know it is so difficult to deal with USCIS and FBI, but let us don't give up, don't loss hope. I still believe that they can't ignore us. Yes, we are unluck, but don't loss hope. we have to try our best to make them know we are existing and we are watching them what they are doing and what kind of mistake they made.

Of course they try to find some excuse to answer us. We don't care, we just need to know what we are asking for is legal.
Try anything we can to struggle for it beacuse we have to live worthy of what we paid for.

hope our case will be approved soon.

No, my name check haven't been approved yet. I am still sitting here and pray for it.
You know all we know we will get there sooner or later.

Hope some people who alreay passed this long and suffering journey can give us some advice.

I just received FBI's FOIPA response to my last Thursday fax. The FBI response came by mail. If you have not received their response, fax to them again. I sent the FOIPA request by mail to them in February and didn't get any response. Who knows what works what doesn't.
