Can somebody help as to what\'s going on with my I140?

Hi Friends,
     I applied my I-140 under EB2 in Aug\'2000 and in december i got a RFE and after that in May\'2001 i got a denial saying that the lawyer did not
submit proper evidence. My lawyer appealed that INS has failed to recognise my Progressive 9 years work experience and so far my case is
still in Administrative Appeals office.
    In december\'2001 i filed again another I-140 under EB3.

What are my chances now. Please advise?

Hi Lava,
Looks like we both are in the same boat. Even my case got rejected recently after I replied the RFE in Oct 2001.I am not planning to appeal anymore as there is no point waiting for another 6 months. Instead I think it will be a good to apply another under EB3.
You should\'nt be having any problems and moreover 140 apps are getting approved in 2 months these days.

Sorry to hear that guys.
When you applied in EB2 you provided original approved labor. So when you apply again don\'t they need original labor again?

can i use the same Labour

My I-140 under EB2 got denied for improper doccumentation.
I appealed again and my case is transferred to administrative appeals office on jan2nd last year. it\'s more than a year now.
My question is, can I use the same labor for another I-140 under EB3??
