Can some body answer me please-- Friends 140 rejected

Friend of mine had problem . He came here with company A and move to company B.

company B said they will GC process and but laid off him after few months. He move to Company C and he filed GC

His labor is thru and file 140 and 485 together . Got his 1 EAD and got an offer from company B with EAD . After 8 months he applied for EAD and AP renewal.

INS rejected his i-140 and stating that " you cannot appeal , but cab reopen". I assume it is because of finical documents of company . Since his EAD is revoked company B is terminated his employment and also said we can your GC from scratch .He left the country and because they filed new H-1 for him .

So my cousin went back to home country.

my questions are what kind of problem he has to face , for new H-1 or if come back on H-1 again what happens to his 485 , if INS approved his 140?

I am feeling it is big mess . Can some body suggest me??

First Place: He changed company after 8 months of I-140 Approval or is it from I-140 receipt date.
If his I-140 is not approved, he cannot use EAD for changing company but he can use EAD to work with the sponsoring employer.

Any ideas from Gurus!...

No As soon as he got the first EAD he started working for new compnay with permission of the sponsoring company . I know it is big mess

any ideas can move back to new H-1 ( remeber it is not transfer).Completly New H-1.

It should be Ok. There should not be any problem. I know some people who were using EAD and I-485 was denied. BCIS asked the vacate the country by coming to their home. They left US and came on new H1 within two months.
